Cooperating with the authorities can bring clear benefits for companies and individuals, but also raises some issues that a company should be aware of upfront. Cooperation can go well beyond a company’s subjective view of helping with an investigation. It can result in far reaching requirements, as the authorities expect ongoing cooperation and open access to information if a company is to achieve credit for cooperating. Therefore, cooperation should be carefully considered from the outset as, once the parameters of the relationship have been established, it is difficult – and potentially damaging – for a company to change its position.
