In December 2020, the insolvency law was amended to introduce the power of the court to cram down tax claims, i.e. to ratify a judicial composition with creditors (concordato preventivo) even if the Tax Administration does not approve the restructuring proposal. In few months, there have already been multiple court decisions, including from the Supreme Court, showing two opposite interpretations. We discussed these latest developments and the future perspectives in light of the new Insolvency Code with Andrea Caravita di Toritto.
