David Schwartz’s practice includes representation of debtors, creditors, and other parties-in-interest in a variety of restructuring matters, including bankruptcy proceedings, corporate restructuring, and related litigation matters.

David has also represented clients in complex civil cases.  

David joined the firm in 2016 and became a senior attorney in 2024.

  • LATAM Airlines Group and its affiliates in Chile, Peru, Colombia, Ecuador, and the United States in the voluntary reorganization and restructuring of their debt under Chapter 11 protection in the United States.

  • Genesis Global Capital, a subsidiary of Digital Currency Group, in its Chapter 11 restructuring proceedings and related litigation matters, many involving issues of foreign law.

  • AMERRA Capital Management, LLC and certain related individuals and affiliates in the defense against estate claims brought in the Chapter 11 case of AMERRA’s portfolio company.

  • Doosan Corporation as an investor and contract counterparty in the Si02 Medical Products Chapter 11 case.

  • HCA in connection with Envision Healthcare’s Chapter 11 proceedings and with certain asset purchases from Envision.

  • HSBC Bank and related entities in defending multibillion-dollar actions related to the Madoff Ponzi scheme and the bankruptcy of Bernard L. Madoff Investment Securities.

  • ESL Investments in its $5.2 billion acquisition of Sears Holdings and related litigation.

  • Punjab National Bank in U.S. proceedings arising out of India’s biggest-ever bank scam involving Nirav Modi and Mehul Choksi, including in connection with investigations being conducted by the U.S. Bankruptcy Examiner and court-appointed Trustee.
