U.S. Supreme Court Upholds Enforceability of Class Action Waivers in Arbitration Provisions of Employment Agreements

On May 21, 2018, the United States Supreme Court held that arbitration agreements between employers and employees which waive an employee’s right to proceed through class or collective actions must be enforced.
The Court held that under the Federal Arbitration Act, such arbitration agreements are to be enforced as written, rejecting arguments that the National Labor Relations Act displaced the Arbitration Act in this context.
