Swaps Trading 2.0: CFTC Proposes Long-Awaited SEF Rule Overhaul

On November 5, 2018, the Commodity Futures Trading Commission voted, on a 4-1 basis (with Commissioner Daniel Berkovitz dissenting), to propose rule amendments to overhaul its regulation of swap execution facilities and its implementation of the Dodd-Frank Act’s requirement that certain swaps be executed on a swap execution facility or designated contract market.
The CFTC also separately voted unanimously to request comment on the practice of post-trade name give-up for anonymous executions on swap execution facilities.
