On March 22, 2006, the New York office authored an Alert Memorandum entitled “OLMS Releases Advisory and Supplementary Guidance on Form LM-10 (Employer Reports).” This six-page memorandum discusses advisory and supplementary guidance from the Office of Labor-Management Standards for employers who are required under the Labor-Management Reporting and Disclosure Act to file Form LM-10 disclosing payments to union officials. The deadline for first-time filers with a calendar-year fiscal year has been extended from March 31 to May 15. In addition, the new guidance clarifies certain interpretive issues relating to the reporting requirements, including issues relating to affiliated companies, acquired companies and public-sector unions, and provides a new exemption for expenditures in connection with certain “widely attended gatherings.”
