On November 30, 2021, Italian Legislative Decree No. 185/2021 was adopted (the “Decree”), transposing Directive (EU) 2019/1 (the “ECN+ Directive”), which aims to achieve a more effective application of EU competition rules by the National Competition Authorities (the “NCAs”).
To that end, the ECN+ Directive provides for minimum standards to ensure that NCAs have the instruments, resources and sanctioning powers to apply Articles 101 and 102 TFEU effectively.
