NVIDIA in Proceedings Before the General Court of the EU

Cleary Gottlieb represented NVIDIA in proceedings before the General Court of the EU, which on September 18, 2024, upheld the finding by the European Commission that U.S. mobile phone chipmaker Qualcomm abused its dominant position through predatory pricing on 3G baseband chipsets sold to Huawei and ZTE.

This ruling is particularly significant as it endorses the first European Commission predatory pricing decision in over 20 years and confirms Qualcomm’s targeted and selective predation aimed at excluding its competitor, Icera, from the market.

Cleary acted for Icera, which filed the initial complaint against Qualcomm in 2009.
