MSD Italia Wins in Pharmaceutical Product Liability Matter

Cleary Gottlieb represented MSD Italia (now Organon Italia S.r.l.) in its win before the Court of Barcellona Pozzo Di Gotto in a pharmaceutical product liability matter.

In a recent judgment, the court rejected in full the claims for damages brought by a patient who allegedly suffered harm and damages arising from the taking of a drug marketed by MSD Italia.

Accepting MSD Italia’s defense in its entirety, the court found that MSD Italia had acted in compliance with all applicable provisions and that, in any event, there was no proof of the “causal link” between the taking of the mentioned drug and the damages allegedly suffered.
