IBC Legal's 2nd Annual Competition Law in the Pharmaceutical Sector 2014

On November 27, 2014, Cleary Gottlieb counsel Pietro Merlino participated as a speaker at the “IBC Legal’s 2nd Annual Competition Law in the Pharma Sector 2014” conference. The conference focused on reverse patent settlement, enforcement of competition law across Europe, interplay between IP rights and competition law, M&A and JV, parallel trade, abuse of dominance, follow-on damages, distribution and co-operative agreements.

Mr. Merlino spoke on “Co-Operative Agreements,” with a specific on (i) licensing and off-label use in light of the Italian Roche/Novartis case and (ii) co-marketing and co-promotion. He also participated in a panel that discussed both co-operative agreements and distribution systems and parallel trade.
