De-mergers as part of the concordato plan: joint liability and effects in case of bankruptcy.
A recent judgment of the Court of Rome addressed a number of issues, in certain cases for the first time, regarding a restructuring plan (in the context of concordato preventivo proceedings) envisaging the de-merger of the debtor. Michele Ciprietti will discuss the key issues raised by this judgment and its implications for corporate and restructuring purposes.
